  <p>Planet Media is developing a new brand and web presence for the Choose Outdoors website. Also, included in their new online present will be an interactive Christmas Tree where children and adults alike can design a tree for the campaign. </p> 
  <p>Over the coming year, the young and the young at heart will be invited to participate in contests that allow them to showcase their talents with competitions in art, essay, songwriting, poster and ornament design.</p>

<title>Spice Up Your Story with QR Codes</title>

<description><![CDATA[<p>These days, QR codes can be found on the sides of buildings, business cards, buses, magazines, postcards… even tombstones! While there has been an increase in their use among (mostly male) early tech adopters, it has yet to be seen if they will be embraced by the mainstream. Many QR code skeptics believe that QR codes may become ubiquitous too rapidly and–without thoughtful analysis of consumer behavior–run the risk of being selectively detuned as ‘noise’. Savvy marketers, brands and job seekers have found ways to overcome the standardization and uniformity of the QR code experience through creative design and compelling campaigns.</p> 
  <p><img src="/cp/data/upload/kwqr_1.png" alt="kwqr_1" title="kwqr_1" align="left" style="padding-top: 10px; padding-right: 10px; padding-bottom: 10px; padding-left: 10px; " height="216" width="364" />The main motivations for consumer QR code use are the coupons, discounts and deals. The second-most-cited reason for scanning a QR code is to access additional information about a product or service. Marketers and brands are closely watching these trends and aim to provide rich content to their audience in ways that are not possible in traditional print media and outdoor advertising. Calvin Klein made good use of QR codes to create outdoor billboards that replaced their traditionally racy ads of scantily clad models with unsexy QR codes enticing users to scan to gain access to ‘uncensored’ ads on their phone.</p> 
  <p>With an increasingly mobile consumer base utilizing their smartphones at multiple, different stages in the shopping process–not to mention the inexpensiveness of QR creation–there are multiple opportunities for brands to provide consumers with content-rich information and targeted deals. In a recent NPR “Planet Money” podcast series, they followed the entire supply chain, design and production process of a t-shirt. They took ideas from listeners that included a QR code that shoppers could scan to get the details of their shirt’s journey from cotton harvest through label printing. In an age where consumers are more conscious than ever about ethical work environments and social responsibility, QR codes provide a great opportunity for narrative brand storytelling.</p>

    <p>Have you ever heard the term “obtaining clearances” or “clearing the rights?” &nbsp;Whether or not you have heard either of these terms, a quick brush-up is probably in order.</p> 
  </div> 
  <div>Let’s start at the beginning. &nbsp;Rights to what you might ask? Rights to the intellectual property of others would be the correct answer. &nbsp;The owners of creative works have many exclusive rights in their property and you don’t want to violate any of them.<br /></div> 
  <div><br /></div> 
  <div>In an average day you probably encounter the results of the public use of the intellectual property of others at least hundreds if not thousands of times. &nbsp;And, you probably aren’t even aware of it. For example, the music that you hear on the radio or on your ipod, for example, is owned by many people. &nbsp;There are lyricists, composers, singers, publishers, instrumentalists and potentially even others who have a claim to the exclusive rights to use their recording, live performance or even the sheet music.</div> 
  <div><br /></div> 
  <div>Walk down the street and notice how many Coca-Cola signs you see; how many Toyota nameplates you view on the cars around you; and, how many products you either use or purchase that are from well known manufacturers. &nbsp;Note the designation ® on all of them which indicates that they are officially registered trademarks in the US Patent and Trademark Office. Any infringement of these rights entitles the legal owner to sue to enforce their exclusive ownership and to potentially obtain damages and attorneys fees from the infringer.</div> 
  <div><br /></div> 
  <div>Clearing the rights to the intellectual property of others can be very complex and have significant monetary consequences to your budget. &nbsp;Clearing the rights then, means obtaining &nbsp;the permission of the owners of intellectual property to use their creative work in your motion picture, your still photo’s, your advertising material and so on.</div> 
  <div><br /></div> 
  <div>There are many variations in the type of permission that you can obtain including the following:</div> 
  <div> 
    <ol> 
      <li>Is the permission being sought and granted exclusive or not?<br /></li> 
      <li>Is the permission geographically limited (only the use in the US will be permitted)?<br /></li> 
      <li>Is the permission time limited (you can only use the creative work for 6 months)?<br /></li> 
      <li>Is the permission limited by medium (you can only put my trademark in your still photos and not in your motion picture)?<br /></li> 
      <li>Is the permission free or must I pay for the rights to use your intellectual property (the right to use my copyrighted piece of art in the background of your interior shot will cost you $1,500)?</li>
    </ol>The right to use the intellectual property of another is called a license, and in order to protect your financing source, protect your distributor, and to appease your errors and omissions insurance policy company, you need to obtain a license in every event of the use of another’s work. There are some exceptions to this general rule, but seek legal advice to assure yourself of the proper use of this property before you start to produce your project. Avoid “ready, fire, aim” at all costs!<br />

    <p>Make sure that your agreements specifically define the rights that you are getting and paying for, and have been well thought through. &nbsp;Otherwise, you could be faced with the prospect of paying significantly more for rights that you should have obtained initially.<br /></p>

    <p>Just as you are the expert in producing your film, use an expert who understands rights and permissions to resolve these important issues before it’s too late.<br /></p>

    <p>Registering or merely using your trademark in commerce is not enough to obtain the full protection of the trademark laws throughout the US. Do you know that you have the affirmative obligation to enforce your trademark rights, and if you don’t, they could be lost?</p>

  <p>You as the owner of a trademark (even if not federally registered) have the power to stop others from using this exact mark or anything else that is confusingly similar. But, how do we determine what a “confusingly similar mark” is in the marketplace? The courts typically look at three factors in their examination:</p> 
  <p> </p> 
  <ol> 
    <li>Will the consuming public be confused if two or more companies are using the same or similar trademarks at the same time?<br /></li> 
    <li>Are the products with the same or similar trademarks being sold in the same manner, in the same parts of the country, through the same retailers or other distribution channels?<br /></li> 
    <li>Is your trademark or one that is confusingly similar, being used on competing products or services such that the sale of one will likely stop the purchase of the other?&nbsp;<br /></li> 
  </ol>

    <div>If your trademark is being infringed by a “confusingly similar” mark, and you can prove a financial loss, or that the person using the other mark has some financial gain as the result of his wrongful use, you may be entitled to damages based upon his profits or your losses.</div>

    <div>If the court finds that the infringer has intentionally copied your trademark, you may be entitled to your attorney’s fees, and punitive damages. Punitive damages are compensation paid to you by the infringer over and above your actual damages, and represent the court’s punishment of the intentional copier for his malicious or willful misconduct.</div> 
    <p>In order to develop and keep your trademark strong, you must continually survey the marketplace for competing marks that may cause confusion and therefore result in a lowering of the value of your mark.
